1. Acceptance of These Customer Terms
These Customer Request Terms apply when you submit, consider submitting, update, or communicate about a service request through or in connection with the InOut Move website, request forms, communications, marketplace features, or related platform tools.
By submitting a request, contacting InOut Move, communicating through the Platform, or using any customer-facing feature, you agree to these Customer Request Terms, the InOut Move Terms of Use, and the InOut Move Privacy Policy.
If you do not agree, do not submit a request or use the Platform.
2. Relationship to Terms and Privacy Policy
These Customer Request Terms supplement the InOut Move Terms of Use and Privacy Policy. If there is any conflict between these Customer Request Terms and the Terms of Use, the Terms of Use control unless expressly stated otherwise in writing.
Your use of the Platform and your submission of information are also governed by the Privacy Policy, which explains how information may be collected, used, disclosed, and shared with independent service providers.
3. Marketplace Nature
InOut Move operates an online marketplace that allows customers to submit moving-related service requests and allows independent service providers to view, evaluate, and respond to such requests, subject to platform rules, location, service category, availability, provider participation, and other factors.
The Platform is intended to help organize request information and facilitate potential communication between customers and independent providers. The Platform does not replace your independent evaluation of providers or your direct agreement with any provider you choose to hire.
4. InOut Move Is Not a Service Provider
InOut Move does not provide moving, transportation, packing, unpacking, loading, unloading, cleaning, handyman, junk removal, furniture assembly, storage, delivery, hauling, or other physical services.
InOut Move does not carry, pack, load, unload, transport, store, clean, assemble, install, repair, remove, supervise, manage, inspect, or handle your property.
Any services you request, discuss, schedule, purchase, or receive are provided by independent service providers, not by InOut Move.
5. Submitting a Request
You may submit information about a moving-related or related service need, including locations, dates, service type, move size, inventory, stairs, elevators, parking, building rules, access restrictions, photos, descriptions, and special instructions.
You are responsible for ensuring that all information you submit is accurate, complete, current, and not misleading. Inaccurate or incomplete information may affect provider responses, pricing, availability, service timing, or service performance.
Submitting a request does not guarantee that any provider will view, respond to, quote, accept, schedule, or perform the requested service.
6. Sharing Request Information With Providers
When you submit a request, InOut Move may make your request information available to independent service providers so they can evaluate, respond to, communicate about, quote, schedule, or perform the specific request.
Information shared with providers may include your name, contact information, service location, destination or delivery location, requested date, service type, move-related details, photos, descriptions, and other information you submit.
Providers are required to use your information only for the specific request and may not sell, resell, or use it for unrelated marketing or lead resale. However, InOut Move does not control every action of independent providers and cannot guarantee that every provider will comply with all restrictions.
7. Provider Responses
Independent providers may respond to your request through the Platform, by phone, by text, by email, or through other communication methods. Provider responses may include questions, availability, pricing, estimates, quotes, service limitations, scheduling options, or other information.
Provider responses are made by the provider, not by InOut Move. InOut Move does not guarantee the accuracy, completeness, legality, availability, pricing, insurance status, licensing status, or reliability of any provider response.
8. Customer Choice and Due Diligence
You are solely responsible for deciding whether to communicate with, evaluate, select, hire, schedule, pay, or work with any provider.
Before hiring a provider, you should independently review and confirm the provider’s business identity, services, pricing, license or registration where applicable, insurance, experience, reviews, availability, terms, cancellation policy, refund policy, and suitability for your specific request.
InOut Move does not require you to hire any provider and does not require any provider to accept your request.
9. No Booking or Service Agreement With InOut Move
A customer request is not a booking, reservation, confirmed appointment, service contract, moving contract, transportation contract, order, dispatch, quote, estimate, or guarantee of service.
Any service agreement, quote, estimate, booking, schedule, scope of work, cancellation term, refund term, claim, or dispute related to provider services is solely between you and the independent provider.
InOut Move is not a party to any agreement between you and a provider unless expressly stated in a separate written agreement signed by InOut Move.
10. Prices, Quotes, and Estimates
InOut Move does not set final service prices and does not prepare, issue, approve, or guarantee binding estimates, non-binding estimates, moving estimates, transportation estimates, or service quotes for work performed by independent providers.
Any price, quote, estimate, rate, fee, deposit, balance, surcharge, additional charge, cancellation fee, refund term, or payment condition is determined by the applicable provider and you.
You should confirm all pricing, scope, timing, access conditions, additional fees, insurance terms, cancellation terms, and other service terms directly with the provider before hiring or proceeding with any service.
11. Customer Responsibilities
You are responsible for providing accurate and complete request details, communicating promptly, confirming provider terms, and ensuring that the requested service can be safely and lawfully performed.
You are responsible for disclosing any information that may affect the service, including stairs, elevators, parking limitations, long carries, building rules, gated access, elevator reservations, loading dock requirements, HOA rules, fragile items, heavy items, oversized items, disassembly needs, pets, hazards, time restrictions, and weather-related concerns.
You are responsible for obtaining any building approvals, elevator reservations, parking permissions, loading dock reservations, access codes, or other permissions required for the provider to perform the service.
12. Access, Parking, Buildings, and Safety
You must provide safe and lawful access to the service location. You are responsible for ensuring that providers can reasonably access the property, building, unit, elevator, loading area, parking area, storage unit, truck, container, or other relevant location.
You should disclose unsafe conditions, restricted access, narrow stairs, broken elevators, damaged walkways, aggressive animals, hazardous materials, unusual parking restrictions, or other conditions that may affect safety or performance.
Providers may refuse, delay, modify, or cancel service if access is unsafe, unlawful, materially different from what was disclosed, or otherwise unreasonable.
13. Items, Property, and Special Conditions
You are responsible for identifying fragile, valuable, heavy, oversized, hazardous, regulated, restricted, or unusual items before hiring a provider.
Providers may have their own restrictions regarding items they will not move, pack, transport, assemble, disassemble, remove, handle, or service. You must confirm such restrictions directly with the provider.
You should remove or separately protect cash, jewelry, documents, medications, firearms, hazardous materials, irreplaceable items, and other sensitive property before any service begins.
14. Communications, Calls, and Texts
By submitting a request, you agree that InOut Move and independent providers may contact you by phone, text message, email, automated message, website form, or other communication methods regarding your request, provider responses, scheduling, pricing, service details, support, administrative matters, or related purposes, subject to applicable law.
Message and data rates may apply. Consent to receive marketing calls or texts is not required as a condition of purchasing any goods or services.
You may opt out of marketing text messages by replying STOP where supported, or by following instructions in the message. Transactional, administrative, service-related, security, or request-related communications may still be sent where permitted by law.
15. Payments to Providers
Unless expressly stated otherwise in writing, any payment for provider services is between you and the provider. InOut Move is not responsible for collecting, holding, transferring, refunding, guaranteeing, or resolving payments owed to or from providers.
You should confirm payment methods, deposit requirements, balance due, timing of payment, cancellation terms, refund terms, additional fees, and documentation directly with the provider before hiring.
16. Cancellations, Changes, and Refunds
Any cancellation, rescheduling, change, refund, credit, deposit issue, no-show issue, or service modification involving provider services is governed by the terms agreed between you and the provider.
InOut Move does not guarantee refunds, credits, rescheduling, provider availability, or replacement providers unless expressly stated in a separate written agreement signed by InOut Move.
17. Claims, Damages, and Disputes With Providers
Any claim, complaint, dispute, damage issue, missing item issue, personal injury issue, insurance claim, delay, cancellation, service quality concern, pricing dispute, or refund dispute related to provider services is solely between you and the provider.
InOut Move may, but is not required to, provide communication tools, request records, administrative assistance, or other support related to a dispute. Any such assistance does not make InOut Move responsible for the provider’s services or the dispute.
You should document service terms, pricing, photos, messages, damages, receipts, and provider communications in case a dispute arises.
18. Reviews and Feedback
InOut Move may allow customers to submit reviews, ratings, comments, complaints, photos, or feedback regarding providers or services.
You agree that any review or feedback you submit must be truthful, based on your actual experience, and not false, misleading, defamatory, abusive, discriminatory, threatening, unlawful, or submitted for an improper purpose.
InOut Move may remove, moderate, decline, or restrict reviews or feedback at any time, but has no obligation to monitor all content.
19. Prohibited Customer Conduct
You may not:
- submit false, misleading, incomplete, inaccurate, or fraudulent request information;
- misrepresent your identity, location, service needs, property, access conditions, or payment intent;
- harass, threaten, abuse, discriminate against, deceive, exploit, or spam any provider or user;
- request unlawful, unsafe, deceptive, or prohibited services;
- ask providers to violate licensing, insurance, transportation, household goods, consumer protection, employment, safety, or other legal requirements;
- misuse provider information, platform content, or communications;
- circumvent platform rules, security features, or access controls;
- post false reviews or retaliatory feedback;
- upload harmful code, unlawful content, or infringing materials;
- or violate any applicable law, regulation, agreement, or third-party right.
20. Privacy
Your submission of information through the Platform is governed by the InOut Move Privacy Policy. By submitting a request, you acknowledge that your request information may be collected, used, disclosed, and shared as described in the Privacy Policy.
This includes sharing request information with independent providers so they can evaluate, respond to, communicate about, quote, schedule, or perform the specific request.
21. No Endorsement or Warranty
InOut Move does not endorse, guarantee, warrant, certify, recommend, or make representations about any provider, service, quote, estimate, review, rating, credential, license, insurance status, availability, price, work quality, safety, reliability, or outcome.
Any provider profile, response, category, listing, badge, rating, review, sponsored placement, or other information displayed through or in connection with the Platform is for informational and marketplace purposes only.
22. Limitation of Liability
To the fullest extent permitted by law, InOut Move is not liable for the acts, omissions, pricing, estimates, communications, negligence, misconduct, violations, property damage, personal injury, theft, delay, cancellation, nonperformance, or work quality of any provider or third party.
To the fullest extent permitted by law, InOut Move will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, lost business, service delays, property damage, personal injury, emotional distress, reputational harm, disputes between users, or damages arising from provider services performed or not performed.
To the fullest extent permitted by law, InOut Move’s total liability for any claim arising out of or relating to your request, the Platform, or these Customer Request Terms will not exceed the greater of the amount you paid directly to InOut Move in the twelve months before the claim arose or one hundred dollars.
23. Indemnification
You agree to defend, indemnify, and hold harmless InOut Move, its owners, officers, directors, employees, contractors, affiliates, vendors, agents, and representatives from and against any claims, liabilities, damages, losses, penalties, fines, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- your use of the Platform;
- your submission of request information;
- your violation of these Customer Request Terms or the Terms of Use;
- your violation of any law, regulation, contract, or third-party right;
- your interaction, communication, agreement, payment, dispute, or service relationship with any provider;
- inaccurate, incomplete, misleading, or unlawful information you submit;
- unsafe, unlawful, or unreasonable access conditions at a service location;
- or your negligence, fraud, misconduct, misrepresentation, or unlawful conduct.
24. Changes to These Customer Terms
InOut Move may update these Customer Request Terms from time to time. Updated terms will be posted on this page with a revised effective date.
Your continued use of the Platform or submission of requests after updated terms are posted means you accept the updated terms.
